so i have a case that is total bullshit in which i am being charged with resisting arrest for not putting my arm behind my back when the cop grabbed it from the top of his car, and for demanding to be told what i am being arrested for, criminal trespass for walking into a bar after being assaulted by a bouncer, and for disorderly conduct for walking up to the bouncer who assaulted me and saying fuck you
i can get a lawyer who will plea bargain me for $700 and i will have to pay $1000 in fines and $180 in court costs, plus i will have to go to a DUI weekend which costs at least $450
or
i can get a lawyer who is the former prosecutor of this city who tells me that the resisting arrest is total bullshit and that he is willing to allow the case to go to trial to fight it, because he feels that strongly about it being a bullshit charge. he is also willing to take the other two charged to trial in attempts to have them knocked down to minor misdemeanors excluding me from any possible jail time and DUI weekend. he costs $1750, but if he only gets the resisting dropped, that will save me $750. |

If you are going to take the plea bargain you don't need to hire a lawyer. Just go with a public defendant.
I'd probably fight it. Jury trial.
However it depends on how well that laywer says he knows/or how familiar he is with the judge on your case. |

this judge made it very clear that if you do not have a lawyer he is going to throw you in jail. this guy is a real rim job who is taking advantage of the fact that he is a judge in a city in the sticks who is rich because of the $30k a year division 1 university located there.
said to a kid who had a 4th degree misdemeanor due to getting two speeding tickets in one year, when asking for a continuance because he did not have enough money to pay for it that day:
"you are facing a possible 30 days in jail. what are you going to do about legal representation?"
"i do not have money to hire a lawyer can you appoint one?"
"do you have a job?"
"yes"
"well then you can afford one"
"well no i can't i have to come up with the money to pay this ticket and pay for everything else i need to pay for"
"if you come back here and tell me that something is more important than 30 days of your life, then my judgment will reflect your decision" |
